1. About these terms
These terms apply when a community hall, village hall or similar organisation ("the hall", "you") signs up for and uses a CozyHalls booking website. CozyHalls ("we", "us") is operated by [legal entity name, company number and registered address — to be confirmed].
By ticking the box on the signup form, the person signing up confirms that they are authorised to accept these terms on behalf of the hall, and the hall agrees to them. Our Data Processing Terms form part of these terms.
2. The service
We host a booking website for your hall at an address of the form yourhall.cozyhalls.co.uk. It lets members of the public see when your spaces are available and send booking requests, and lets your administrators manage bookings, enquiries and invoices.
Every new site is reviewed by us before it goes live. We may decline a signup without giving a reason, for example if we cannot confirm that it is for a genuine hall.
3. Free plan
The booking site is free of charge, with no time limit. Free sites display a small "Powered by CozyHalls" link, which must not be removed or hidden. Additional paid features may be offered in future; you will never be moved onto a paid plan without your agreement.
4. Your account and administrators
You are responsible for the people you invite as administrators, for keeping login details secure, and for everything done through your administrator accounts. Tell us promptly if you suspect an account has been compromised.
5. Acceptable use
You must use the service lawfully and only for the hall's genuine bookings and communications. You must not:
- publish content that is unlawful, misleading, defamatory, discriminatory or that infringes anyone else's rights;
- send spam or unsolicited marketing through the service;
- attempt to break, overload or gain unauthorised access to the service or other halls' sites;
- use the service to collect personal data you have no lawful basis to collect.
6. Your content and data
The content you publish and the booking data on your site remain yours. You grant us a licence to host, copy and display it only as needed to run the service. When we process personal data about your hall's customers, we do so as your processor under the Data Processing Terms; the hall is the controller and is responsible for its own privacy notice and for having a lawful basis for the data it collects.
7. Availability and support
We aim to keep the service available and secure, but we provide it "as is" and cannot promise it will be uninterrupted or error-free. We may carry out maintenance, and we may change or improve features over time. Support is provided by email on a reasonable-endeavours basis.
8. Suspension and ending the service
You may stop using the service at any time by telling us. We may suspend or close a site if these terms are seriously or repeatedly broken, if required by law, or to protect the service or other users. Except in urgent cases we will contact you first. We may also stop offering the free plan by giving at least 60 days' notice. When a site closes, we will give you a reasonable opportunity to export your data, then delete it as described in the Data Processing Terms.
9. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Because the service is provided free of charge, and subject to the previous sentence, we are not liable for indirect or consequential loss, loss of income or bookings, or loss of data that could have been prevented by you keeping your own records, and our total liability under these terms is limited to £100.
10. Changes to these terms
We may update these terms. We will tell your administrators by email at least 30 days before a material change takes effect. If you do not agree to the change, you may stop using the service.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
